What is the Collective Agreement?

The National Collective Agreement for umbrella employees was signed on March 22, 2017, between social partners, then made mandatory for all umbrella companies from April. It establishes clear rules to protect the rights of umbrella employees and regulate umbrella company practices.

This collective agreement completes the securitization of this new form of employment, in application of ordinance n° 2015-380 of April 2, 2015, ratified by law n° 2016-1088 of August 8, 2016, relating to work, modernization of social dialogue, and securitization of professional pathways.

Who does this collective agreement apply to?

Who is covered?

  • Umbrella employees as defined by Article L. 1254-2 of the Labor Code
  • Umbrella companies operating in French territory (including overseas departments)
  • Categorical agreement (umbrella employees are not part of the workers-employees college)

Exclusions

  • Personal services (prohibited in umbrella employment)
  • Functional employees of umbrella companies (different collective agreement)

Key principle: The umbrella employee initiates the service and chooses their umbrella company.

The 3 Criteria for Umbrella Employees

Conditions defined by Article 2 of the collective agreement

1. Autonomy

The umbrella employee has autonomy in decision-making:

  • Approach clients of their choice
  • Define the scope and extent of services
  • Agree on the price with the client
  • Organize their own schedule
  • Freely search for clientele

Consequence: The umbrella company has no obligation to provide work.

2. Qualification

The umbrella employee must have at minimum:

Option 1

A professional qualification of level III minimum (Bachelor's degree)

OR
Option 2

Significant experience of at least 3 years in the same sector

3. Expertise

The umbrella employee has particular expertise:

  • Set of specific skills and knowledge
  • Recognized mastery and know-how
  • Ability to evaluate professional opportunities
  • Capacity to prepare and execute projects
  • Ability to negotiate with client companies

Calculation based on the 2017 Social Security Ceiling: €3,269/month

Financial reserve

Mandatory 10% savings paid at contract end or during inactivity to secure periods without assignments.

Business contribution bonus

5% bonus of base salary that rewards the umbrella employee's autonomy in client prospecting.
